This website is owned  by Luxury Gift Experience. By accessing or using this website, you agree to the terms set out in these terms and conditions and the terms of any other documents which govern your use of the website, including the Privacy Policy.

These terms and conditions apply to the sale of the vouchers for goods and services promoted by luxury gift experience and delivered by the third party. These terms and conditions apply to the exclusion of all other terms and conditions, unless we specifically confirm otherwise in writing.

Please read these terms and conditions carefully before placing an order with us. In these terms and conditions, “luxurygiftexperience.com” and “us” and “we” and “our” refer to luxury gift experience.

Terms & Conditions for Online Customers

By completing the purchasing process you’re agreeing to be bound by the terms and conditions shown below. These terms and conditions do not affect your statutory rights.

General

  • We have no responsibility for any services provided or not provided by any other party listed on our site. We accept no liability for any act, omission or default, whether negligent or otherwise, of any third party service provider and have no liability for any loss or damage incurred by any negligent act or omission of any third party service provider or any other third party.
  • Where liability cannot be excluded, such liability is limited to the value of your order. We make no warranty or representation regarding the standard of any third party services to be provided to you.
  • All Gift Vouchers are issued subject to the terms and conditions of each third party business and their terms. We do not have any power or control over third party service providers and their operations. We take all reasonable precautions to ensure that the suppliers we promote are safe and reliable. However, we make no guarantees or warranties about the services which are provided to you by third parties.
  • Notwithstanding that we will take all reasonable precautions to ensure that third party service providers are licensed and compliant, where a third party service provider is not properly licensed or compliant with any applicable law, bylaw or regulation, we accept no liability for any loss or damage suffered by you or any third party as a result of such non compliance.
  • Nothing in this terms and conditions will limit our liability for death or personal injury caused by negligence or wilful act or omission of trulyexperiences.com or its employees. Except as specifically set out in these terms, to the extent permissible by law, we disclaim and excludes all other warranties, whether express or implied, by statute or otherwise.
  • These terms and conditions do not affect your statutory rights as a consumer.
  • This website contains various blogs, updates, offers,competitions and other features that are each governed by additional rules. Please read those rules, posted or linked at each feature, before participating in them, as they form part of these terms and conditions to which you agree through your continued use of this website.
  • This agreement shall be governed by the laws of Scotland.
  • We undertake to comply with the provisions of the General Data Protection Regulation (GDPR). For further details please refer to our Privacy Policy.

 

Privacy & Security

When you shop with us online we ask for information like your name, email address, delivery address and telephone number. We do not store any credit/debit card details. This information is necessary to enable us to process your order and liaise with you about your order.

 

Restrictions

  • All luxurygiftexperience.com experiences are offered subject to availability.
  • Please note that the selection detailed at the time of purchase may change from time to time. trulyexperiences.com reserves the right to change its activities or its hotels or restaurants, during the validity of the Gift voucher.
  • Some suppliers are able to welcome disabled persons in their facility. We advise to ask about accommodating disabled persons at the time of booking.
  • Each experience is subject to the supplier’s cancellation policy as such, it may include, but is not limited to a non-amendable policy.

Information about your specific experience can be found on the product page, by checking with lge@luxurygiftexperience.com or in your booking confirmation.

Refunds, Cancellations & Exchanges  

  • If you are a consumer and have purchased your Gift Voucher Experience from us using our website, you have the right to cancel the Gift Voucher with us at any time up to the end of fourteen days starting the day you receive your Gift Voucher and ask for a refund.  The refund will be returned to the cardholder who purchased the experience.
  • To exercise your right of refund, you must give written notice to us by email, giving details of your order and (where appropriate) its delivery. Notification by telephone is not sufficient.
  • You have 12 months to contact us to book your experience, please contact the provider at the time of booking to check when the voucher must be redeemed, as each providers terms and conditions of use are different.
  • Once you have notified us we will refund or re-credit the purchaser for the price of the Gift Voucher (excluding delivery charges and credit or debit card fees).
  • You do not have the right to ask for a refund once you have booked your activity with a supplier/ experience provider.
  • Refunds are always made to the person who purchased the Gift Voucher, and if originally purchased by credit or debit card, the refund will be credited to the same card. If the card has expired you will need to request a refund in writing, quoting your bank account details (Account Number / Sort Code / Name).
  • If luxurygiftexperience.com ceases to operate, suppliers will not be liable to fulfil any unbooked experiences for which they have not been paid for by luxurygiftexperience.com. Purchasers will instead be able to seek a refund from the payment provider.
  • In the event that the merchant or service supplier is unable or no longer able to provide the product or service specified, an alternative (equivalent or better) will be suggested to the customer. If no suitable alternative can be agreed upon, equivalent value credit will be issued to the original purchaser of the Gift Voucher.
  • Voucher can not be exchanged for cash.

Cancellation

As a consumer you have the right to cancel your contract at any time during the period which starts on the day you purchase the voucher from Luxury Gift Experience, on the expiry of seven working days. If you want to cancel your contract you should notify us by email lge@luxurygiftexperience.com.  We will ony refund the cardholder if the voucher has NOT been redeemed on the LGE platform. If applicable the delivery cost and gift box is non refundable.

Payments

Payment can be made by Visa, Visa Electron, Visa Debit, Visa Delta, MasterCard, American Express, Maestro debit cards, and any other methods which may be clearly advertised on the Site from time to time.

Payment will be debited and cleared from your account upon placement of your order by luxurygiftexperience.com. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorise payment to luxurygiftexperience.com, we will not be liable for any delay or non-delivery.

We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed using pay pal, stripe, secure online payment gateways that encrypt your card details in a secure host environment.

To help ensure that your shopping experience is safe, simple, and secure, luxurygiftexperience.com uses Secure Socket Layer (SSL) technology.

Furthermore, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the LGE.

Content

In addition to the Intellectual property rights mentioned above, “Content” is defined as any graphics, photographs, including all image rights, sounds, music, video, audio or text on this LGE. luxurygiftexperience.com tries to ensure that the information on this site is accurate and complete. luxurygiftexperience.com does not promise that luxurygiftexperience.com Content is accurate or error-free. trulyexperiences.com does not promise that the functional aspects of LGE or luxurygiftexperience.com’s Content will be error free or that LGE, luxurygiftexperience.com Content or the server that makes it available are free of viruses or other harmful components. We always recommend that all users of the Internet ensure they have up to date virus checking software installed.

Vendor Ceases to Trade

If the vendor/experience provider, ceases to trade before the voucher has been redeemed, LGE will either refund or transfer the voucher for another experience of equivalent value. If however the voucher has been redeemed with vendor/experience provider, then the  liability is with the vendor/experience provider and we would ask you to contact them independently to discuss payment.
